Hi I have filed my I-485 in 2004 with PD 11/2003. What documents do I need to file for my wifes 485 if i filed it my self. I have given the list below let me know if I missed any thing.

- Photocopies (front & back) of all I-94 cards for spouse

- Color photocopies of Visas in Passports for spouse

- Color photocopies of all passport pages for spouse

- Photocopies of any previous USCIS approval notices for spouse

- Previous F-1 holders – copies of all I-20s (front & back) and EAD card

- Photocopy of Registered Marriage Certificate

- Photocopy of Registered Long Form Birth Certificates for employee and all dependents (Birth Certificate must include names of both parents)

- Photocopy of Bank Letter/Bank Statements

- Photocopy of pay statements for the last two months

- Photocopy of current and previous tax returns along with W2 statements

- Form I-693 Medical Exam for employee and all dependents (See instructions below)

- Two photographs for each application (I-485, I-131, I-765) (See instructions below)

- Color photocopy of Driver’s License

Most important document and I did not see it in your list  ..... a copy of your I-485.

It would also be very helpful to add a cover letter requesting USCIS to link both applications together and specifying your app as the primary. You may think this would be obvious, but clearly specifying such stuff avoids any mess later.

Just my 2 cents .....

Cheers !!

raka006 , there is a strong possibility that your I-485 could be approved with in first few days of July, so better you go through a experienced lawyer for filing your wife's case(this way mistakes are avoided) and send the completed I-485 petition to USCIS by express mail so that it will reach on July2nd.

Strangely USCIS approves I-485 exactly at those times when someone does not need it to be approved and delays for people who beg for it.

the only time this is a problem is if the spouse is here on H4 right? (since the approval of the I-485 would invalidate the H1-B and hence the H4 status of the spouse). If his spouse is on some other status (H1B/L1/F1) then even if his approval comes through, it should not impact her ability to file her 485 right?

Affidavit of support and employers documents?

Thanks every body for the concerns,

My wife is on H1 and am not sure if that helps my situation.

I am also wondering what documents would me required by my side other than.

1) Copy of my I-485 filing
2) Affidavit of support?

3) Do I need a letter from my employer etc?

If i go with a lawyer I may not make the July 1/2 date. I have to see how it goes.
