filing I 140 using labor substitution

Hi,

I have 8 months left on the H1B. I am planning to change employer and the new employer has a pre-approved labor which is is willing to use.

I have checked and found that the job description on the labor is exactly same as mine. My concerns are:

- The labor is dated 09/2001. Would that be an issue?
- Any issues that I may encounter if I file I140 and I485 concurrently.

I have filed the same about 10 months ago and when my paper submitted to USCIS at that time only 3 months left. So you should not have any problem.
