Filing i-140 , help Needed!!

Hello All-

Do we need Experiance Letter From the Present Employer whom i started working when my H1B first got Appoved 2 years ago in order to file I-140??

I have kind of similar problem....

I worked with my previous employer for few months in a year. But I was on & off from project.... So basically I worked for a month and then no project for couple of months again got a project for 1 and half months and so on....

Now in my resume i showed total ONE year of experience [I did mention my lawyer / emloyer about this before Labor was filed]

Last week i got 1-140 application from my lawyer for my signature. I see a form " ETA 9089" and in there my experience is shown as full year.[Which is incorrect] Also My previous employer is not giving any letter neither I have any friend working in that company....

What should I do ??? I am not feeling comfortable in signing the I-140 application as I feel it would be a lie and it might affect my case.... What can be done???

Any help would be appreciated.

Law unless proven doesnt consider anything a lie or truth.
Having said that now its all in your mind.

So if you feel in the heart that its a lie and you cannot sign on the paper? That does not lead you anywhere.

Get into it deeper.

Do you feel having lied, you will be able to get through it?

or

Do you feel, having lied, it will throw upon you back and you wont be able to get through it?

Answer the above two questions honestly and believe in one of them strongly.

so its the INTUITION, do what your heart says. At time your heart and mind might not coincide. That is when I chose what the heart says.

For I140 and LC, you can put whatever year experiences (even it is not true).
HOWEVER, if the LC said the min requirement is 2 years experience and skill set A, B, C.

You must have a letter or multiple letters from 1 or more employers with total year experiences is 2 ( NO overlap and count per day. If the letter show in month/year. You should count 0 day for that month). Plus those letters must state all skill set A, B, C (you don't have to have all of them in all letters, but some are in 1 letter and some are in other letter...) Or you just waste your LC. I know a person in my company just waste her EB2 LC (PD 2003) few months ago because she put that she had MS+1, but she can only get the experience letter of 8 months. Of course, other employee is happy now to get that sub LC. And she cries a lot but after that the company applies PERM for her with MS+0 and got approved but she missed the Sept deadline.

Before doing LC, your lawyer should ask if you can get experience letters to prove your employment and skill sets. If you can't, let them know at that time.
