I'm new to this forum and sincerely appreciate any suggestions/advice. My situation is that my PERM labor is approved in EB3 (India) category (PD Nov2006) & willing be filing I-140 shortly. Assuming I-140 is approved by end of 2007, but I won't be able to file I-485 until PD becomes current(may be next 4-5 yrs...). My 6 yrs of H1 end in early 2008. Meanwhile, I expect my Canada PR to come through before end of 2007. My question is-
1. After canada PR is approved, can I move to canada and wait there until my Priority Date becomes current ? and will I be able to file my I-485 at that time with Consular processing?? When I move to canada, I will be leaving my H1 employer, but the company confirmed they can keep my GC application going. I'd like to utilize canada PR to work there until GC comes through.
2. Leaving h1 status before filing I485 - will this amount to cancellation of GC process?
