Filing I-130 Question 14 (I-94)

Hi,

My wife is filing I-130 and we are stuck on question 14 which is

14) If your relative is currently in US. complete the following: He or she arrived as (visitor, student, stowaaway etc)

We wrote "None" since she came here as a permanent resident.

And also the follow up question:

Arrival/Departure Record I-94 Date Expired
| | | | === | | | | |

I checked her passport and she does not have any I-94. What am I suppose to write in the Arrival/Departure Record I-94 field and what is the format to write it.

Thanks for the reply. She will be citizen by the end of this month and we are preparing for my green card papers.

So, I will submit all the required documents as soon as she becomes a citizen.

oK. so the questions regarding the status of entry is refering to YOU, (to the beneficiary). Then you must specify the visa type you used to got into the US and also the I-94 number.

the questions on the left side (PART B)of the application refers to the petitioner (your wife), the questions on the right (PART C) side refers to the beneficiary (you)

Read above, I updated my last coment withj more details. Please double check your application after filling it. You may have the PART B wiht your information and PART C wiht your wife! Start over! it will save you some headaches!

one more question. I am looking at my I-94 card. And I can see the departure number which I have to type on I-130.

the number is like this:

XXXXXXXXX XX

Do, I have to type all 11 numbers or only first 9.

my I-94 has eleven digits in the same format the show it in the application 000-00000000

I just checked the I-94 card and it does not show me any date expired. I am currently on my H1B visa.

Answer #14 (by order):

- "Visa H1B"

- "000-00000000" "00/00/0000" (date arrived)

- "NONE"


Remember to fill every empty spaces with NONE or N/A

Well for answer 14.

I came here as "Student". So here is my answer # 14 (by order)

"F1 (Student)"

000-00000000 (date arrived)

"not sure about this one since now I am on my H1B"
 
but the question refers at the moment of your entrance. In other words, if at the time you entered with F1 visa, your I-94 did not have an expiration day, you should put "NONE" because there was not expiration date for the I-94 in particular.

Thanks! Yes the moment I entered US in 2002 my status was F1 (student)

So, I guess the order will be

F1

I-94 number (date)

"None" (since there was no expiration date)
 
Yes sir! that's right.

Just dont forget to go over the PART B again, remeber at the begining you had a misconception for whom the questions were refering to.
