Hi all,

This is a query related to my buddy who just got married and I hope your answers will help him clear his confusion.

My Buddy is a newly naturalized US citizen who flew back to his native country and got married, a month after he got naturalized. He's currently back home with his wife and he wants to know whether he could initiate the process to take his wife to the U.S.

Also, he's yet to file for taxes. What are the requirements on that front? ( eg: Income, tax filing etc ).

Your buddy will need to file for a spouse visa (K3) for his wife. I am not sure how long the process takes, but it sure won't be done by Apr 15th. If he is planning on joint filing, your friend's wife will need a SSN (which is not possible with K3 visa I think), or an Individual Taxpayer Identification Number (ITIN) from the IRS. Physical presence is also required to obtain an ITIN.

If he had failed to file taxes, how does he intend to prove that he has sufficient income to sponsor an immigrant visa?
