This is for a friend for whom I am asking this help from this forum.
He has question related with filing for permanent residenship for his sister. Following is history of his immigration.
- His aunt filed for permanent residenship for his family in 1983
- His parents received their greencards in 1995.
- Based on his father he and his sister also got greencard in 1996.
- Now his sister is married in India and wants to give up her greencard. But at the same time she wants to make sure that he will be able to file for Permanent residenship for his sister's family when he becomes citizen in this year so that her kids can have an option to come to U.S once they grow up.
So my question is: Is he eligible to file for permanent residenship for his sister and based on today's condition how much time would it take?
The reason I am asking this question is, someone told me that as per the new rule, specially in his case, after becoming citizen he can only file permanent residenship application only for spouse, childern and parents. BTW his parents are on GC but not settled in US and they have no plans to become citizen in near future.
Any help in the matter will be appreciated.
