I would like to file I-130 next month for my brother with the purpose of bringing him to the USA. (with green card) Does anybody have an idea how long this process might take? or just an insight.

thanks all

I think they are currently processing cases filed in august 1997, for "rest of the world", for India, China and Phillipines it's late 80's and early 9o's, the sooner you file the better off you are, hopefully your brothers children will take advantage of the US immigration, or better yet find him a nice girl if he's single. You can go to shusterman.com and look up visa bulletin.

what about if you file for your mother? the time line is same?

I had no idea! Gee!! I thought it would be sooner. The kid is only 18 and i want to bring him here asap. i am going to file for mom and dad and it probably will be approved very quick. But the problem is, if mom files a petition for him, with green card, wouldnt that be longer? I think i have to look into that much deeper and find other ways to bring him here.

Thank you all. I am going to file for all of them and when my dad and mom get their permanent resident status, they can file for him as well. I will be going through this path within the next year orso if any of you ever need help, just PM me.

Is this a typo ??? Are you serious ? Why does it take that long. Just asking out of curiousity.

If I file for my sister and it takes 10-15 yrs, is it true that she won't be able to come visit anymore during that time under the Visa Waiver program?

Priority Dates can be found in the current State Dept Visa Bulletin.

You'll note that dates for Family 4th Preference (Brothers & Sisters of Adult USC) are way out.

China: Dec 1996
India: Nov 1996
Mexico: Nov 1994
Philippines: Feb 1986
Everywhere else: Jul 1997

TSC doen't work on I-130 any more. You have to send a form I-130 to Chicago, and after the initial proccesing, for those who live at TSC district and file for relatives, documents will be sent to California SC . I think they finished with docs which has been filed till APR 30,2001. That's why check CSC visa bulletin

Lextran,
Unfortunately, her brother will not be able to come with parents, because this category is not "follow to join" ( doesn't matter how old kids are-1 month old or 18 y.o.)

Hi Everybody,

I am going to have my citizenship interview on 16 th april 2008 (VSC).Hopefully I 'll be naturalized very soon.I have few questions

#1. Can I apply for my spouse and my parents at the same time.If yes, Will there be any kind of delay for applying all together ?In that case I'll apply according to my preferences.

#2. My brother who is already here in USA holding a OPT (Optional Practical Training.) visa.It will expire by August 2008. Initially he had F1 /student visa.after the expiration date he has to go back to home country. Can I apply immigrant visa for him too. I know it 'll take many years as a family Fourth prference(brothers and sisters),but at least can we save his legal status ?

If this case stays pending for 5 to 6 years, Can he work legally in this pending situaton ?
or can he visit the home country and come back to USA ?

Thank you all in advance.I appreciate all your efforts.

I think he should go back home. I don't see any ways to keep him here, unless he extent his stay with a valid visa.
On your side, you can not keep your brother on a legal status.
You sure can apply for I-130 for spouse and parents at a same time and it shouldn't delay anything. Since you are paying the i-130 for your spouse, you may want to consider applying for I-129F after I-130 in case that goes faster. Recently I-130 approvals are faster than their own alternate way K-3 visa.

Please check on my above sentences to make sure you are on the right path.

goodluck
