Filing for I -140 and I - 485 with Preapproved Labor

Hi People has anyone had any experience with filing for I-140 with pre approved labor. As I recently got a job offer and they said they could file for my I-140 with a pre approved labor.

1) I already have filed for labor with my present employer and have been in queue for past 10 months and it will take another 6-8 months to get the labor approved.

2) So when I got this new offer where in I can file for I-140 right away (2-3 months) I am very tempted but I want to know any gotcha's and any other requirements etc for this.

Thanks for any input for experiences that you all can share with me.

one of my friend applied I-140 with a pre-approved labor, after the new regulation came along he applied I-485. His I-140 is still not approved. So I guess you can apply too, you might wanna talk to your lawyer though, don't take my word for it.

I have not yet joined the new company. I want to evaluate all the pros and cons of it before I do so as my present employer is processing my GC as well. But going to the new company will give me a head start of 6-8 months on the I-140 & I-485 process.


I do not work in the field of IT. So if you are looking for employers in IT I am affraid I can't help you.
 
Yes, you can use an LC that was approved for another employee and has not been used if you are being offered the position described in the LC AND you met ALL of the requirments stated in the LC when the LC was filed. You need to have your attorney review your qualifications and the LC very carefully. Also, be certain that the company has an ORIGINAL, CERTIFIED, LC. A copy is not good enough.
