Hi,
I have seen some similar cases to mine but not an exact one, so I had to start this new thread.
The situation: I was employed by A till June 30, when I was laid off. I had however joined B on June 27 (date of receipt notice for H-1 transfer). I did not file under PP and it is still expected to take another month (as on Oct 6). I have been working for B and am on its payroll. (I hope this is what is referred to as working under 'portability').
Now I just received another offer from C. My questions now are:
1. Can I file for a visa transfer to C since I have pay-stubs from B and the receipt of H-1 filing for B?
2. If yes, will appreciate if you could identify some risks involved, and the documentation that I will need.
3. Would the safest option be to expedite my B processing through Premium Processing (can that be done in the middle of the process?), and once the transfer approval comes, file for transfer for C?
