Hi,
I filed and got approved I-140/EB2-NIW in 2006. I-485s for both my wife (dependent) and I (primary) are pending due to retrogression. Have used AP and EAD from this pending I-485 (pending at TSC, originally filed at CSC)
Now my wife's company may file I-140/EB1-OR for her. This is attractive to us since EB1 is current. In that case, they can also file I-485s for both of us in which she will be primary applicant and I will be dependent.
My questions are:
1) Is it possible to have two I-485s for each of us pending?
2) Will the new I-485s be given the same A# as the first I-485s?
3) Do we have to withdraw the earlier filed I-485s?
4) Will we get new AP/EADs based on new I-485 applications?
5) How will this affect the first set of EAD/APs?
Of course we would consult with our lawyers about this, but I though it would be great to hear from those of you who have experience with this and the pros and cons of this step.
