Filing Amended I-140 questions

I have an approved EB2 I-140 with PD of Jun 2006
From the same company EB3 labor with PD of Jun 2003 got approved recently.

So my lawyer filed an amended I-140 based on the approved I-140 and the EB3 labor(with PD Jun 2003) so that he can get EB2 I-140 with a PD of Jun 2003. One month after filing this he says that this amended petition will be denied. But he is not sure what other alternatives he can pursue.

Could anyone please let me know what other options I have. Could I just file a EB3 I-140 based on the approved EB3 labor. Is it okay to file EB3 I-140 after getting an approved EB2 I-140 from the same company?

Please help.
 
If the amendment based petition is going to be denied, then you are better off filing straight EB3 140 for the 2003 labor. After it is approved you can port the old PD to the new EB2 based application.
