Hi all,

I am USC and applied for i-485, i-130, and other forms for my wife's greencard application.
And this was in JAN 2004.
She was F-1 student until we got married in JAN 2004.

We never got a notice of receipt for i-485, but got one for i-130.
She applied for EAD in JULY 2004, but it seems that it got denied (???) and then resumed processing on FEB 2005.
She had her FP done in SEP 2004 and since then, nothing has changed other than case is pending.

When we call the service center, all they say is that it's not been approved....

We live in Northern VA, so all the files were sent to Wash DC district (Arlington, VA office).

From people with similar cases in our area, it should only take about 1 year from applying for greencard upto receiving it.

I wondering if hiring a lawyer at this point would help.
Or is "WAITING" our only option....???
 
Your I-130 was forwarded to the Service Center and that’s why you have a receipt for it, but I-485 is still pending in Washington DC office and most District Offices are not in a habit sending receipts for pending I-485.

According to the chart : https://egov.immigration.gov/cris/jsps/officeProcesstimes.jsp?selectedOffice=80 they are working on cases filled in April, 2004, several months past your date.

Your “WAITING” is up.

Call Customer Service Center at 1-800-375-5283. Ask them to make an inquiry.

Contact your local congressman.

Make an infopass appointment with Washington DO office to personally go there and talk to the officer.

DC office has issues

I also had wiered experiences with DC office around Dec 2003. I agree with the previous adivse. Search the forums on infopass too. Otherwise you will get no appointments. You have to try around 5PM to get in the system. Ask specifically why I-485 is not approved. Try to have all copies available in case they have misplaced it.

I have setup an appointment thru InfoPass.

Funny thing is that I tried that with "English" language....and never could get anywhere.
But my wife tried once in "Korean" language, and it worked!
