Filed I-485 late oct - will be laid off in a week Options

Gurud,

I filed I-485 last month and will be laid off next week. What are the options if any. i.e anything like changing visa and to what type? I did not file for EAD can I still do that? Gurus help !!!!

Apply for EAD asap.

Make sure your company is not going to withdraw your I-140. Since you already filed for AOS, you are in status till INS decides on your application. So no need to go on other visa right away. Even if you are laid off, you will not be out of status. However in order to work for another job, you would need either another H1 or EAD. Try to get a similar job and THEN HIRE A GOOD LAWYER in order to continue your GC process and take advantage of AC21. Good luck.
