As I understand, if the H-1B petition was filed before the underlying F-1 status expired, the foreign professional is not out of status even after 60 day period.
My question is if the H-1B petition was files after the underlying F-1 status expired and he/she has only extensional 60 days to stay in the U.S. Would the foreign professional be out of status after 60-day granted period? If yes, would it be possible to request for extension from INS until the H1B petition is approved?
