Filed for Adjustment Status but file send for Consular Processing

Received a letter from US embassy New Delhi on March 13,2003.

.....you are hereby notified that your application for immigration visa has been canceled and any petition for you has also been canceled.
....
...

After trying for 3 1/2 hours got in touch with immigration offices at New Delhi. She told me that we had send you a letter on Feb 5th 2002 regarding your consular processing but have not received a response from you.

I told her that I never received any letter in Feb 2002 and never applied for Consular Processing( and I had my F.P and medical in U.S) . The she replied me that in that case we have your file here and you or your lawyer should send us a written inquiry so that we can send your file back to united sates.

Don't know if I'm really F _ _ _ _ D.

Seriously you are fu**d. I don't know what to say, only I can laugh at INS. It will be sort out but it will take ages and lot of followup.
So good luck and start fingering your lawyer.

Hey Paaji dont worry, vipsha dont scare him. I know of a colleague in an exact same situation. They send it for CP in Mumbai though he had filed ADJ . Anyway to cut a long story short he managed with the help of his lawyer to get it back to ADJ of status and within a week he was approved.The whole process took about 3 weeks . That is a reason why one should call IIO once a while to make sure the case is active here. Anyway dont worry you will be fine. Most probably on your I140 CP would have been mentioned by mistake . So approach your lawyer asap and hopefully in 2 -3 weeks you should have an approval or RFE. Good luck
 
pa_ji, all of us are fucked anyway, we're dealing with the INS afterall. Never know you mgiht get yours in 6 months (CP is faster).
 
My 140 is also approved for CP but I applied for 485. No need to worry. It might take some more time but you should be fine.
 
I never meant to scare Pa_ji, Infect I never came across such case but I can easily believe that INS can do it. In normal cases INS takes sooooo much time than in this kind of case god knows. But as soumy knows one such case and time lines so it is good for Pa_ji to make him happy.

Pa_ji, If I scared you then I am sorry.

What INS has done is not a big deal they can do anything except approval, thanks to INS that they didn't send the application to jhinhua (Don't ask me where it is)
 
what are the dates of this application (RD/ND) for 485 applied.. wanted to see how fast is consular processing as against AOS
 
R.D and N.D for I-485 are dec 24 and dec 26,2001.
According to my talk with Immigration officer at Embassy in New Delhi They sent me a letter on Feb 06,2002( which I never received). So If I really had applied for C.P I would have got approved by that time.

Well life really SUCKS:D
 
Can you please tell if the letter from the consulate was mailed to the US address

Was the recent letter stating that the petition was cancelled mailed to you to your US address from the consulate.

I had talk with my lawyer
According to him:
"Don't be alarmed. You are an applicant for adjustment of status so you are fine. The Consul's notice simply means that is canceling any further visa processing and returning the I-140 to the INS (now called BCIS.) This is what we want, frankly, since the BCIS needs to have the original petition to complete processing of your adjustment application. If all goes well, your adjustment should be approved in the next couple of months. Stay tuned."
