Hi ALL,

I filed TAX FORM, CA 540 NR, in the year 2001 (for the year 2000),

As i was a part year CA resident (from May to December 2000),

I got my green card (immigration visa) in April 2000.

DO I HAVE TO SAY 'YES' TO THE QUESTION :-

****************************************************

PART 10. Additional Questions (Continued).

C. Continuous Residence.

Since becoming a Lawful Permanent Resident of the United States:

13. Have you EVER called yourself a “nonresident” on a Federal, state, or local tax return.

*****************************************************

DO I HAVE TO EXPLAIN THAT I FILED CA 540 NR form in the year 2001, for the year 2000.

I DID NOT FILE AS A "NONRESIDENT", BUT AS A "PART-YEAR" RESIDENT.

I DID NOT FILE AS A "NONRESIDENT", BUT AS A "PART-YEAR" RESIDENT.

SUGGESTIONS CAN ALSO BE MAILED DIRECTLY TO MY e-mail# "sgupta@road-inc.com".

THANKS

I don’t know how much emphasis CIS places on the state tax (my guess is not as much as on the federal). But if you want to be extra cautious, I *think* you need to show which state(s), other than CA, you were a resident of in 2000 and that you filed a 2000 state tax return for that one, too. I mean, if you were a part yr resident in CA, where did you live in Jan-Apr of 2000 (i.e., before you became a PR)?

Also, in my knowledge, part-year resident is closer to, or treated as, nonresident.
