filed 1-485<180 days, changed a job

I was lay off 2 months after I filed I-485, I changed to a new job with same job title within 1 month, before my H-1B expired.

According AC21, do I still have change to get my I-485 approved?
If INS asked for RFE, what should I do?

Any responce are apreciated.

The following are the basic requirements for applicability of AC21 rulesin your situation.


You should have an approved I-140
Your I-485 should be pending for 180 or more days
You should find a similar job with a new employer.

In your case AC21 rule is not effective as according to you, you have not completed 180 days after you have filed your I-485.

What you can now do is wait for the required 180 to get over. If your AOS is not adjudged before that, you can give a letter from your new employer with job discription as given in your LC. Also ensure that your old employer doesn't cancel your I-140.

I already got my I-140 approved. I filed i-485 Oct, 2001, and did FP this Jan 31, then no further info until now....:confused:

Should I file some new documents from the new employer? I transfored to the new company with same job tiltle at Dec 2001.

If the I-485 failed, are there any chance to appeal?

Any similar cases?
