Dear Folks,
The following is my situation:

1) Forth year Ph.D. student in computer science and expect to graduate at the end of the year.

2) Future job is very likely to be a post-doc position in industry research lab.

3)Current thesis work and future job will be in the same broad area but with some differences.

4)currently don't know the details of future work yet.

My questions is: When should I file my NIW and which of the following options is the best for me?

1) file before graduation with focus on my thesis work
2) file after graduation with focus on my thesis work
3) file after graduation with focus on my future work and try to make connection with thesis work

Thanks!

Technically, if you don't have your Master's in hand (went straight for a Ph.D., like I did), you are not qualified. Otherwise, you CAN do it, but whether it would be a wise move, I am not sure. Depends on a whole bunch of factors I won't even try to analyze here. And, there's that I-485 vs. F-1 (you're on F-1, right?) issue. Consult your lawyer, I'd say - number of firms (not saying which ones, to avoid a shameless plug - do your own research) offer free initial consultation/evaluation. And, no, I am not competent to give legal advice, either. In any case, good luck!
