Have anyone thought of having the new employer to file another set of I140/485, while they also write a letter to use AC21 for the old set? Will this work?

As long as you can bring the LC with you to the new company, I think it's prefectly legal to file another set of 140/485. Plus the new pilot program, you may be able to get GC in three months. Any comments on this approach?

I don't think LC is transferrable. It belongs to your employer. But again AC21 defeats this reasoning...AC21 is a grey area which lot of people interpret it in their own ways....

Hope USCIS comes out with some clear definition for AC21....

My 2 cents....Any other thoughts....

I checked this with my lawyer. She said it's not viable unless the new company is a subsidy of the original company which filed the LC. She did not meantion AC21 can be used to defeat the above company relationship rule.
