file labor certificate after EB1

Hi, All,

I am considering to ask company to file labor certificate for me. My EB1 extraordinary ability I-140 petition was filed six month ago. In this way, in the case that my EB1 petition is denied, I could use Labor Certificate as backup. The question is: is there any problem with this double petition (one is with INS and one is with local state Department of Labor)? Thanks for help.

Sorry to hear about you. It is common to apply through LC at the same situation like you. You may also think to reapply under the same or different category simultaneouly with LC. Many people do it. Can you please post why your EB1 application was denied?
 
My EB1 extraordinary is still pending with INS. I am considering to file LC just as backup in the case that my EB1 CASE get denied. (HOPE not). Thanks
 
I am in a similar position -- my lawyer filed EB1-EA in Jan 2003 and also labor certification -- my company tells me my labor certification has been approved -- what happens of my EB1 EA is not approved? I have got labor certification.
