My I-485 file is pending at local office in FL. I485 application sent to Texas Service Center in Aug, 2007, but due to high volume at that time, they moved it to Nebraska. I got the receipt number which starts with 'LIN'. In 2009, file moved to National Benefit Center and subsequently moved to local office in FL for an interview. Interview has been completed in April, 2010 and pending for approval since then.
Recently 3 months back, my new EB2-140 approved. Following are the follow ups for the past 2 months regarding porting:
1. Mailed Porting request to the Streamline account and got the response from EBUPDATE.Tsc AT dhs.gov saying request has been received
2. Mailed follow up mail to ncscfollowup.nsc AT dhs.gov on yesterday(4th Aug)
3. Mailed Porting request to local office in FL
4. Mailed Porting request to the Officer who interviewed us at local office in FL
5. I personally submitted new EB2 I-140 copy twice during my 3 info pass appointments
6. Request sent to congressmen, waiting for the response
During my 2nd info pass appointment, After showing new EB2 140, Supervisor told me you would get your approval by Friday. After 2 weeks, lost my hopes, took 3rd Info pass appointment today. I got strange answer 'Your visa is not allocated by Homeland'. I told the IO my case is current for the past 2 months and asked why visa is not allocated? Finally realized that they are not familiar with Interfiling concept and always referring my old I-140 copy in the file. I don't know how to convince those dumb officers who doesn't know the procedure. When explained the scenario to the 2nd level IO at 1800 number, he told me take a note of the IO names and affirmation and proceed to Ombudsman.
Appreciate advise on this issue.
