File 485 but visa # unavailable

I am born in INDIA and have filed 485 eb2/ PD jul 2002. Now with the visa number being unavailable, my case would not be looked until oct 2006. If in October the eb2 for india retrogresses further before jul 2002, will my case be processed (as it is pending and I have ead/ap) or will it have to wait till the current date is Jul 2002. Any thoughts welcome?

Your 485 case will be put on hold until immigrant visa becomes available for your priority date. It doesn't matter how the visa bulletin dates fluctuate, as long as your date is after the cut-off date, the case will be on hold. However, since USCIS has already accepted the 485 filing, they will continue to issue/extend AP/EADs regardless of this hold.

When can I file I-485 (and get an EAD)

Hi,
I received my Labor approval a few weeks ago, but am yet to file I-140 and I-485. I was wondering if you could give some clue as to when is the earliest that I can file I485 ?

Thanks

GoodCard it could be up to 3 to 5 years due to retro.....

Sounds ridiculous. I have already waited 3.5 years for getting my Labor approved. Now another 3 -5 years seems unimaginable to me. What do you think are my options ? Do you think it makes sense to file another application through PERM under EB2 category ? Also, is there a website which can show the status of visa numbers ?

Thanks for any pointers.

Mate,
I am in the same boat as you except for my 140 was approved within a few months. EB2 filing for indian national is not even an option currently. Retrogression is bad news dude...read up in detail different threads in this forum. For me personally I had no clue about the whole retrogression deal until I found out my 140 has been approved but we cannot file for 485 in the near future. Since then I have spent sometime on this forum and must say I have a good understanding of how this works. All one can do is wait!!!

Do I need to worry, my son will become 21 next year?

Me and my family are pending for i-485 (eb3, pd:11/2003)
do my son have an issue if he turns 21 and his i485 still not approved?
