Fifteen Days Of Hell!!!

Atlast USCIS has announced today that they will accept I-485 petitions till Aug17th with current fees, I was hoping that they will increase the visa number quota and provide more relief to GC aspirants. It was a tough time for every one between July2nd and today(15 days).

I see that the decision they have taken is just to revoke the July2 bulletin update. The emotional pain and suffering every one has undergone can never be compensated, atleast they should increase the annual numerical limit for EB visas to 300k and only consider primary applicants for visa number calculation.

Amidst this turmoil, there is a silent group which did not get much limelight but have gone through the same pain and anguish, they are those who filed their petition in 2003/2004/2005 and waiting for their approvals, with july2nd bulletin it was not clear to them whether their cases would be approved or if visa numbers would be lost and how many more years of wait...

Now things are clear, all the old cases which are documentarily qualified(as of june30) would be approved in the coming few weeks, and those who are eligible to file 485's can do so by august 17th.

Surprisingly I got my approval notice today(EB3 PD:OCT06, 485 RD:DEC04, AD:07/17/2007), Iam even more happy that july2nd bulletin is revoked and everyone can file now.

Good luck for everyone.

Only Congress can increase the quota or authorize the recapture of unused numbers from prior years. With the mountain of people who are about to file, there will be some pressure to do one or the other.

Interim benefits still allowed

cool_desi_gc,
Yes. AOS applicants are still eligible for interim benefits such as AP/EAD even though PD is not current.

The wait time for EADs is likely to be in the 6-month range given the thousands of applications filed in June and now in July.
..... Unless, USCIS puts some additional resources to EAD cases... highly unlikely, but let's just hope for that.

wish it started from the filing date... but alas

It only starts from the approval date.
This is the reason why spouses (and sometimes, applicants) are required to wait until they have the approval notice / EAD in their hands.

Now that EAD processing dates are already retrogressed we can expect anywhere between 4 to 6 months (or even more) due to the amount of applications.
