Fiancee v/s marriage

Hello all,

I am very confused about something here. Why is is that you can bring a fiancee over to the US like almost immediate and they can STAY here but if you are already married you have to wait like 6 months!? :(

I'm seriously considering getting married TWICE (once in South Africa, then once here) by filing for fiance visa just so we can actually BE together! Why would I even bother with marriage visa when fiance visa grants entry and ability for her to work here so much faster?

Isn't there a special visa to allow a spouse to be in the US while waiting on change of status?
 
Well, you are missing the one little point of actually applying for a Fiancee (K-1) visa and how long that takes. I do not know in your husband's country, but in mine it takes around 8-10 months... :rolleyes:

And after you finally bring him here, you have to Adjust Status... which takes around 4-6 months...

So, is not all that better than going through Consular Processing and getting an Immigrant Visa.

ps: Also, do not lie to USCIS. that is a BAD idea.

Thank you for the info. I must say that I would never contemplate nor condone lying to any USCIS. No one says you cannot get married in two countries. .. but I guess with your info, the question is pointless anyway.

Hope this will give answers to some of the questions been asked. http://pretoria.usembassy.gov/wwwhvisas_iv6.html I am also a South African citizen married to a US Citizen here in the US but I will be going to SA with my wife to get married there again so its perfectly legal. Oh by the way the cases processed in Johannesburg go quicker
