Fiance not to change last name after marriage?

My fiance is not agreeing to change her last name to mine after marriage.

1) What can be the ramifications of this at the time of the interview?
2) Can we face any posisble difiiculties at the time of the intterview?

The law does not require spouse to change last name after marriage (unless you are on H1 and applying H4 for spouse, then it becomes mandatory for H4 spouse to change last name in passport). It is perfectly okay if last name is not changed. Dont worry, my wife did not change her last name either, and i bet you would find a majority of people here in the same situation.

There is no law that requires a spouse to change her last name to her husband's. Infact, even H4 spouses are not required to do so by law. Its one's own prerogative, though some foreign consulatesdirect to do so eventhough its not the law. Infact, my wife used her own last name (did not change her name to mine in passport) for H4 stamping without any problems and was issued a H4 visa. She has even filed AOS under her own last name. So get over this old world name change BS!

Yup. I agree. It depends on the country from which you apply for H4 and its more of a consulate rule rather than a USCIS or DOS rule.

my wife kept her last name too don`t know why ?

My wife name has been changed on the marriage certificate but never had the time to change it on her green card or social security card . No laws requieres it and she been living like that for the past 5 years.

There is so much about it around this forum and at the end it's a personal call.

Is your wife call, if she doesnt' want to change it nothing will going to happen. We are living in the 21st Century and we (women) can use our maiden name.

I am married for 9 years, my wife has not changed her last name either. No issues what so ever.
