Fee waiver

Me and my wife filed for a fee waiver for the form I 751 she lost her job and my hours have been cut. They denied it, we went to court and they told us to file a again, so we did. This time they told us that they can not accept it because it is late. .

She arrived here in December 2006 we now have three children together and one on the way our daughter from the Philippines is with us now also.

What can we do. Called both of my senators and both of them told me to pay the fee they can not help.

Can they deport her and if so what can we do to stop it. We do not have the money for an attorney.

We have to go back to court next month and do not know what to tell them.
 
Stop wasting time in court. To get the initial GC approved you had to show that your finances were strong enough, so they expect you to be able to afford it. They're not going to waive the fee unless something really extreme happened, like you had a major medical problem that disabled you and ate up all your money. Mere job loss is not a sufficient reason. Hurry up and file the I-751 with the fee before they put her in removal proceedings. Borrow the money or take it from a credit card if you have to.
 
WE are all ready living on borrowed money as for credit cards we filed bankruptcy. Having two children that had to stay in the hospital for three weeks at birth cost us twenty thousand.

To late she is all ready in removal proceedings.

If it goes to were they will deport here all I have to do is file an appeal to the Attorney General Of The United States and prove to them it will be a hard ship on me. With five kids I do not see a problem with that.

Even though it is only about $630 at this time we just can not afford it. We have two kids that are sick and we sent all of this in to USCIS.

All the form I 751 is rally for is to prove are marriage is in good faith. I think we did that with the three kids and one on the way.

Here lies a problem we all know that they will not deport her, if so they would have to deport all of the anchor babies moms. If they will take a payment plan put us on it.

How much money did our government give companies to bail them out.

Their criteria for hardship is much more stringent than that. It would have to be more extreme, like you if you died or became severely disabled and nobody else can take care of the children if they deport her. There are thousands of other people with cases worse than yours that get deported.

How long were you married when her green card was approved? If it was 2 years or more, they should have already given her a 10-year green card. So that is one way to fight this; if you were married that long and USCIS did their job right, you wouldn't need to file I-751 at all. Otherwise, she will get deported, especially if you don't have a lawyer to fight it. Once that happens, she'll have to wait outside the US until you can file for another green card.

Too much, but ordinary people like you and me are not close friends of Congressmen or the President.
