Feb. 2002 filer, no 2nd fp yet! help please

Hi,

I am a feb 2002 filer (RD: 02/12/2002) and did my first finger print in June 2002. I live in PA. I gave my first finger prints in PHILADELPHIA ASC. So far I didn't receive any Rfe or fp2 notices. I am in my 3rd EAD and 3rd AP.

I called customer service so many times, but I didn't see any response from BCIS.

I called the senator office in PA, they made an inquiry with VSC. Senator's office told me that my first finger prints were expired and VSC have to schedule for my second finger print and VSC didn't give them any specific timeframe for that. I asked the senator's office, can they ask VSC to expedite my case, but they said it not possible. It is possible only if there is an emergency.

Can any body suggest any other options that I can try.

It is sad to see people with RD 02/02 still waiting for FP2, while people with RD 03/03 or even later getting approvals without even going for FP2.

May be your attorney can make an expedite request. Please contact them. You can even give a mail to Prakash Khatri's office giving your detials and explaining the pain. I hope at least one of these will help.

I sent the following letter to Prakash Khatri last month and got a reply that I will get some response within 45 days.

Respected Sir,

I filed my 485 applications in the last week of June 2002 and have completed my fingerprinting in the last week of August of 2002.

Since them I have 3 Employment authorization cards and Advance Parole documents in order to work legally in the US and maintain my status. My Advance Parole is still Pending with USCIS. This is impacting me severely in my ability to make economic as well as social decisions for my family.

It is with great frustration I have to write this email to you about the processing of the cases. It is not being done in a fair manner. There are applications that have been filed in early 2003 to late May 2003 that are being processed and approved while immigrants like me and also immigrants who filed a year before me are still waiting for their cases to be touched. This is totally unfair.

The Ombudsman's office is your best chance. Please note that earlier statistics showed Philly as being too late for second FP.

I got my second notice for 7/30 and after I sent e-mail to his office even though I got no official second reply back (30-45 days).

I understand your fellings,it took me 18 months to get 2nd FP since my case was transferred from VSC to NYC and 27 months since FP1 .I thought they had lost my files.I applied for 3rd EAD last dec. and received it on Feb./04.I was ready to contact senator when I received 2nd FP notice and interview appointment letter 4 weeks ago...Do not loose your hope,your day is comming soon.
