Feb 1/02 RD RFE Just Issued

My RD/ND is Feb 1/02. An RFE was just issued on April 8/04. I have no idea what they are looking for as my case is an EB-1 based on Extraordinary Ability, so I have no employment sponsor, my medicals are fine and my FP's are fine.

Anyone else in this situation???
 
sydney, you are getting closer. that is at least good news.
i feel TSC is now looking at Feb 02 stack.
 
It's really rare to see EB-1 get the RFE. But my guess is the same as curiousGeorge's.

My guess is probably to see if I've continued working in my field while I've been in the U.S., or to see if I was out of status at any time. My FP's and medicals were fine, so any other ideas anyone??
 
hey, never know what procedures they follow to adjudicate a case!

Anyways, just hang in there - atleast the fact that "someone" opened your file(s) is an indicator of progress. Do not get too worried about it.

I would guess that they probably want you to provide documents to demonstrate your legal status.

As long as you have all the supporting docs to support your EB-1 ategory, you shouldn't be worried at all. No matter what the RFE is for. Just take it easy and wait for the RFE to come through. My gut feeling is, they just want to verify some of the info that you provided. And there is no need to worry at all if you reply them properly. So, good luck and share your info when you have it.

The RFE just came in as follows:

Submit a letter, on company letterhead, from the applicant's employer attesting to applicant's job offer or continued employment and a brief description of company's business, the applicant's specific duties, and level of compensation.

I am an EB-1 based on extraordinary ability and I was my own sponsor. I have no employer as I have always been self-employed!

Any thoughts on how to respond??

I was wondering, whether you applied your I-485 through a lawyer or did by yourself? Either way, my personal advise to you, approach the lawyer for preparing that letter. They know the proper language and what to write & these TSC guys understand that. You dont want to take any chance when you have come this far. Ofcourse, gather all the information from the forum members who share their thoughrs or their personal experiences. Do not rush but take time and respond well. You can respond to the "continued employment" part by sending copies of your last few year's annual tax returns (that prove you earned a living) and, if you have available, any documentation of services that you provided to your clients as a self-employed individual (say, contracts, invoices, maybe even letters from your clients attesting to the work you have done etc).

You should also write a cover letter explaining that you are self-employed (as permitted under the EB1-A category) -- thus the "employment offer" is not applicable in your case.

Of course, you may wish to consult a qualified immigration lawyer to be sure that you are responding to the RFE in a satisfactory manner.
