FBI- Name Check Response

Finally I recieved an email response from FBI after nearly 6 months...see excerpts below.

Due to increased national security concerns, in December 2002 to early 2003, the USCIS submitted an additional 2.7 million name checks for processing to the FBI. Although 99.8% of these cases have been finalized, our efforts to complete the remaining requests continue. This has delayed processing of other requests.

You may be assured that the immigration authorities will be advised at the
earliest possible date upon completion of your case.

USCIS had sent my Name check request to FBI on Jan 3rd,2003 and as on date this is still pending. Hope this info is useful for others who are in the same boat as me.

I also received the same message from FBI for the email sent by me on Jan 4th, 05.

I am waiting for what needs to be done next.

probable interpretation of delay

I don't think being an SR country or not is an issue. It would helpful if posters stated if they are from an SR country or not and also if the last name is common. I have noticed that Zhang a common last name gets a "hit" and moves from an automated name check to manual verification process and results in delays. So those who are waiting for some time please add what you think might be the cause of the delay. Even interaction with the cops can result in a "hit" requiring a manual check. Hopefully we can work out the trend from the postings of members. Small sample size though.
 
My son is still waiting for his name check to be done. We are from Canada and have a very uncommon last name. There's probably only a couple of hundred people in the entire world with our last name.

That being said, I'm still waiting for a response from the FBI to see if the USCIS has even sent the name check request to them. My son was 13 when we started the I-485 process, so no name check was needed. Now when they went to approve our cases, they noticed he was well over 16 and that there was no name check response in his file. So they're probably sitting there waiting for the FBI response totally unaware that they've never asked for the name check in the first place. I and my lawyer have pointed this out in several emails and phone calls, but still no movement.

Myself, my wife, and my 2 other children have been approved for about 4 months now.

Why don't you do a consular processing for him? Canada is close by. You could do a DCF (direct consular filing).

Very soon your son might loose out on scholarships at college if the processing is not done by then.

I am from India and my Last Name is uncommon. I have no criminal records with no speeding tickets as well :-)
 
In my oppinion

In my oppinion, it's just like in airport . Some cases are getting pulled out of the computerized queue for the manual checks. Of course you can also have a computerized system "hit" and they will also pull you from computerized queue for the manual check. This is random process and there is not much you can do if you are hit.
