FBI name check not initiated yet..April 16, 2003 ND

I got the response from David Hardy for my e-mail to FBI name check. I don't know what's happening. Our GC approval will only be in dreams if these incompetent USCIS personnel at VSC are not given a shock. Can I contact a senator or congressman (official processing still 6 months back). If name check is not requested how can one get through security clearance.

This is in reference to your emailed dated September 28, 2004, concerning the immigration status of you and wife. A review of the FBI's Name Check Program database does not indicate that a request has ever been received from the U.S. Citizenship and Immigration Services concerning you or Suneetha. Therefore, you may wish to recontact the USCIS' local office for further processing of your case.

I guess you had emailed FBI. I have seen only response only to fax so far... I have not tried contacting FBI yet. Planning to do some time latter this month..

I am in the same boad with you! I just now received a phone call from FBI Name check department and told me that my Name Check has not been request yet by USCIS, where as my spouse's name check was request sometime in March 03 and they have sent the response back to USCIS.

I don't know now how I should react to this. We are all suffering because of some inefficient process in USCIS office. USCIS has messed up my application and apart from that they have also messed up my whole process.

I don't know how I should make USCIS to send a request to FBI about my name check.
 
needhelp1...we need to solve this issue...

I just now talked to my congressman's office and they said that they will follow up my case with INS and the lady over there has suggested not to inform USCIS that I have been following up my case with FBI as it will make USCIS look very bad and they will keep my case in the end of the log.

So now all I can do is just PRAY...PRAY...PRAY GOD to help me in this difficult times...... :confused:

Looks like same thing happend to my case...I am suspecting great USCIS not requested name check for my case also.

online Messeage always says the fingerprints for your I485 Application to Register Permanent Residence or to Adjust Status were collected and are pending review since 02/20/04. I also send a fax and email to Fbi for name check 5 weeks ago still no response...........
 
Sorry to hear that USCIS hasn’t requested the FBI check. Is it normal? It seems to be an easy process, which takes only couple of days for FBI to complete the name check and results sent to USCIS.

It is USCIS's fault for not requesting name check from FBI for this long right? It is not FBI's fault. Am I correct?

This is not normal. USCIS sends name checks in "batch" to FBI. It takes maximum 45 days to run such checks. Recently USCIS has been sending FP1 only after name check is done and in the final stage of approval. Folks who got FP1 in >= Sept are relatively safe with respect to name check. Note that FBI name check is different from FP name check.

Any idea about FP2 done on after sep-04, is their name already check done ?

This name check is independent of your FP. The namecheck in question (discussion) is something that CIS initiates with FBI once per 485.

The other check is done against your fingerprints whenever you are called for fingerprinting. This is different from the namecheck mentioned above. This FP check is "usually" completed by FBI the same day.
