FBI clearance- question

As per my Receipt date and the dates on TSC I should have received my 485. But unfortunately I have not. So I called TSC ( thanks to POJ) to get the status and I was told that it was pending FBI clearance. So I asked my attorney to follow it up. My lawyer called TSC service center and the agent told to wait 30 days to get a reply from TSC.
Following are my questions:
1. Is FBI clearance is same as name check?
2. Does my attorney following it up with TSC( ofcourse through phone only) makes things any better? I am expecting the same information from TSC that they were waiting on FBI clearance.
3. I have alreaday e-mailed 2 months back and sent a fax 2 weeks back to FBI. Is there anything that I need to besides crossing fingers?

Please let me know
Thanks

Chakor,

From the look of things your case is awaiting "Name Check" clearance from the FBI. Hopefully this will be completed soon. You may want to start looking into making inquiries with the FBI by writing letters to them.

Chakor!! I have the same problem!! I emailed FBI 4 months agoand so far have not heard from them. I have send them letters as per POJ recs 2 weeks ago--so far no progress!!

Today I have called TSC and much to my dismay I was told that my case was pending to be reviewed by an officer. I asked the reason and the lady kept saying that it was pending. I asked if she could atleast tell the reason. But no luck...

If so many cases are still pending, how the heck TSC is saying that its processing OCT 2004. It doesn't make sense

Just an update and a question

I have just contacted the FBI 202-324-3625.

FBI receptionist: Did you send an e-mail?
me: Yes I did. Two months back
FBI receptionist:Well, we are currently looking into the e-mails received in February.

It is very very fustrating to listen to such replies. Is it so hard to query a simple database and say
on what date they have received it and whether it is currently being processed.

I called my attorney's office and asked whether they have any plan of action. My attorney would like to wait till they get official letter from USCIS stating the same thing what I have already found. Then they would think what to do next. Is it hard to have a plan of action.

In fact what my attorney would be able to do in such cases? Can any one suggest, so that I can tell my attorney what do next?

chakor,

If there is one thing I have learned form this process it is that one should not believe everything the TSC reps tell you over the phone. A lot of them give wrong information just to get you of the phone. Case awaiting "Security Clearance" is a favorite for them. You have now called TSC twice and the update has not been the same. I have gone through this a lot. Infact my wife and I called the TSC about 5 times over the span of 10 days and to our astonishment we got a different reply each and every time. We were told that our security check is pending, that our FPs were not there, that everything was fine and just waiting for an officer to look at the case. We stopped calling them after this because their replies made things worse.

You lawyer is right about one thing. Until you get some sort of written update from the TSC stating that the delay is indeed with your "Name Check" it will be hard to go to a Congressman for help. I guess the safest thing to do is wait for the FBI email and see what it says. Another thing you can so is ask your lawyer to put in a formal inquiry over the phone which will prompt theme to reply via written letter. That letter may state the reason.

The worst part about all this is that there is very little recourse for us. We are at the mercy of some very incompetent people who don't give a damn about immigrants in general.

Time Duration for the FBI Name Check.

Experts please clarify me,

Could somebody tell me, how long it would take for the FBI to do name check.

The reason why I am asking this is because,
I gave my finger printing in March and my wife gave it in may.

When I checked the 485 Status, For my wife it says

On June X, 2005, the results of your fingerprint review for your I485 Application to Register Permanent Residence or to Adjust Status were received, and processing has resumed on your case. We will mail you a notice if further action is needed, or when a decision is made.

and for me it still says
Your I485 Application to Register Permanent Residence or to Adjust Status was received on October XX, XXXX. We mailed you a receipt with information about processing. It is taking between 850 and 900 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.

Could any one tell me How this is possible, When I called FBI Finger print line they said they sent my Figer print status right next day after finger printing to USCIS.

But there are so many LUD's on my mine and my wife's 485 as recently as 08/29/2005.

Can I guess that my FBI Name Check is not done Yet and wife's is done.
Out of your experience could you tell me how long it normally takes for the FBI to do Name Check.

Any help is appreciated.

Thanks!
