My interview date may be in Febuary,or March 2008

1.Is my home country, albania, on FBI check for DV interview?
2. Do you guys see a reason for an FBI check from my story below,or any forecoming problem i should get prepared. I have had a clean histroy in any country i have been before, including usa?

I was from 1996- july 2001 on F-1 studetn visa in usa, graduated with a B.A. . From July 2001 to july 2002 on Optional practical training.
Then i was thinking of returning home in albania because i could not find a sponsor for a job. Then i changed my mind and in November 2002 applied for reinstatement to begin a nursing program the spring semester 2003 since you could get the green card through a nursing job. I got an answer in June 2003 that my reinstatement was denied, should apply to my home country embassy for readdmission. I appeard before an immigration judge got volunteer departure untill september 2003.Left usa in august 2003,began an oversee study program in europe. My lawyer that was representing me at the time said that i had not accumulated unlawfull presence becuase i appled for reinstatement 4 months after my f-1 status expired in july 2002.

3. Can you request an FBI check,if needed, way ahead before the interview, by writting to the FBI and paying the required fees to be send to the embassy requested.

Hope somebody more experianced like LucyMo could give you good answer, however it seems that there is an issue for which you might be asked on the interview, but how serious are the matters in your case I do not have clue.

For LucyMo

Unfortunately, this is not possible. The consular officer will decide if your case requires further "administrative processing". This is done at the Department of State in Washington, DC and may or may not involve review by other federal agencies, including (but not limited to) the FBI. Based on what you've written, I don't think you will have any issues since you weren't "unlawfully present" in the US.
