FBI merged a dozen anti-terrorist "watch lists" into a single database. officials who issue U.S. travel visas would have access to a database containing more than 100,000 names.

hope it could result in the less time on the name check in I-485 procedure.

Don't mean to throw a wet blanket on your optimism, but..

While there are certainly some cases held up by security check bottlenecks at the FBI, the vast majority of the delays are due to INS's own deficiencies. The FBI, despite all the criticism it garners, is a very well run organization and is certainly nothing like the INS. It is hard to imagine a process where the FBI is the weakest link.

If your case is held up by security considerations and falls within the timespan of current processing, this may help. For most of the folks here though, it is just a red herring.
 
INS's own deficiency is not sufficient to explain the big increase of I-485 processing time (since Nov 2002) while that of other types of applications(140 & EAD) has no big increase.
 
INS apparently believes that AOS applicants are not adversely affected by their pending I-485s because in the eyes of the agency, they can apply and receive benefits through EADs and APs (How we all wish this were true). So they accord lower priority to I-485s than almost all other applications. EADs get adjudicated relatively quickly for this same reason. I-140s are a different animal altogether as the applicant is a US legal entity and would hence be able to ask a federal court for a Mandamus Writ if an administrative decision is taking inordinately long.

do you think the security check is just FP? at moment, I think
the whole security check procedure is a black box, or at least a grey box.

maybe it is a transparent one for ur guys. If that's true, please help me to figure it out by the following questions
1) what elements does security check include?
2) is name check a part of security check?
3) FP check is before name check?

Pork Chop: Can you please help and clarify on the following questions? I appreciate it.

Are there any differences between "Security Check" and "FBI Name Check"? I have called the IIO 2 times: Aorund 1.5 month ago IIO said your application is under security check ; and 2 weeks ago IIO said it is under FBI name check!!! He also mentioned that the file will be returned to the officer to be adjudicated!! By this last statment does he mean they will finalize their decision or they may send more RFEs!!!!

I appreciate if anybody can clarify on this!! thnx.Aghajan

take your best guess, bud! since the BCIS or DHS have not come out with too many explanations on their new security procedures, we are all quite in the dark. i imagine that the FBI name check is either synonymous with, or a subset of, the security check.

as far as adjudication following security clearance is concerned, i think that just might refer to whatever documentary protocol the adjudicating officer would have to follow once the security clearance for a case is received.

of course, if several months have passed since the adjudicating officer last looked at a file, there is nothing preventing them from issuing an employment RFE, or any RFE, for that matter. but one hopes that they, too, feel that there should be an end to the agony, both theirs and ours.

I agree with some parts of what Sankrityayan mentioned. If BCIS presumes would be immigrants can get the benifits from AC21, EAD and AP while I-485 is pending, then, BCIS is wrong in its assumption. Any number of intermediate benifits would not substitute for a approved GC.
 
FP

I did FP on April 2002. No second FP request yet. Does anybody know what I can do for this. any suggestion?

You don't have to do anything. I too was having the same question until last month. My first FP was done in Apr, 2002. I got an RFE last month and within a week after replying the RFE I got the second FP notice.

What's your RD? It seems NSC has started processing Jan 2002 cases. If your RD is in Jan 2002 you might hear something from NSC very soon.
