Father Born in Myanmar – DV Lottery, EB-5, EB-2 Options? Can I Use Cross-Chargeability?

I’d appreciate your help in understanding some U.S. immigration options for my family. I have a few questions regarding DV Lottery, EB-5, and EB-2, especially related to cross-chargeability.




‍‍ Background:​


  • My father was born in Myanmar (Burma) in 1953, but has been an Indian citizen for decades.
  • He had heart surgery, but is stable and living in India.
  • My parents were married in 1980.
  • I am 30 years old, unmarried, and born in India.



❓ My Questions:​


  1. DV Lottery for Father:
    Is my father eligible for the DV lottery because he was born in Myanmar, even though he's an Indian citizen?
  2. EB-5 Option:
    If we do a joint family investment (father + son), can he apply under EB-5, or does each applicant need their own $800k+ investment?
  3. Health & Age Factor:
    Would my father's age (72) or past heart surgery negatively impact his chances in either DV or EB-5?
  4. Cross-Chargeability (Main Question):
    Can I (his son) use cross-chargeability to Myanmar for EB-2 or EB-5 or any other family-based category, even though I was born in India?
  5. If Father Gets Green Card (DV/EB):
    • If my father becomes a green card holder, and files I-130 for me, what’s the current wait time for F2B from India?
    • During that time, can I enter or stay in the U.S. on another visa?
