Hello,
Has anyone had the experience of getting the I-140 and EAD approved within a couple of weeks of filing. My case is fresh - September 2005. My approval notices came just one day after I received the receipt notices. I could not believe my eyes. My country is from Western Europe and has visa numbers currently available and has always been available, and my case is EB2. Can these incredibly speedy approvals mean that my I-485 also can be approved in a pretty quickly? Any experiences to share in terms of the correlation between really, really fast I-140 approvals the I-485 approval timeline?

I wish there was a correlation between the two, but there isn't. My I-140 approval came fast, but you can't expect yout I-485 to come this fast. Nebraska for example is looking at I-485 applications from June 2004, which means that my application is collecting dust eventhough there is visas available for my country!

On the other hand, Nebraska is showing that they are processing I-140 applications from March 2005. I applied in August 2005 and I was approved in the same month! So this clearly doesn't make any sense, but I will take it :D Could another miracle happen with our I-485 applications? Who knows!

Do you know if the priority date would matter in that case? For example, the Vermont Service Center is processing I-485 cases from September 23, 2004, but my priority date is from November 2003, meaning that my priority date is 9 months prior to the current application dates they processing. Similarly, the VSC currently processes I-140 applications from March 19, 2005, but when they received my I-140 two weeks ago, it apparently bypassed all other cases and ended up being processed immediately, perhaps based on the PD dating back to November 2003. Do cases with PDs way before the current processing times get priority over those with PDs after, assuming that all cases have current visas and are NOT affected by retrogression? In other words, does a way early priority date in comparison to the current processing date make the application an actual priority? Any thoughts on this?

You are mixing things up :) Priority Date is different than Receipt Date. The dates published on the USCIS site are Receipt Dates. So in theory they process applications based on Receipt Dates first and then Priority Date.

In our case since we are not from India or China we might get our applications processed first. For example, If you and a person from India have a priority date of August 2002. This person from India applied for I-485 in September 2002. You applied in September 2004. IN THEORY, your application will be processed first because the Vermont Center is processing cases submitted in September 2004 or earlier. The advantage you have over the person from India is that your priority date is current and his is not!

If you replace the person from India with a person from your country, he will have the advantage over you because his receipt date is way ahead of you.

I hope this helps!
