I wish to receive some advice on an immigration petition that I filed on my brother's behalf. The case was under administration processing by the US Embassy in Islamabad, Pakistan. The embassy contacted my brother in May and asked for him to submit his passports stating they are ready to process the case. The embassy kept the passports till August; at which time we asked for them to return the passports. The brother and his family needed their passports to continue their lives.
They kept the passports for nearly four months and did no action. They already had the case under administrative process for two years prior to them asking for passports in May. What should be our course of action going forward. Is it legal for them to hold the passports for so long. They had the case under AP and contacted us saying they're ready to process.
