Family based immigration - birth certificate

Hi,

I have couple of questions on family based immigration sponsored by sibling,
who is a US citizen. The instructions for I-130 says that brother/sister has to provide birth certificates of both of us. I do not have birth certificate, so I got the 'non-availability' certificate for my birth proof along with affidavits from my parents. My brother did the same when he applied for his green card in the past. Right now, he does not have these documents with him for whatever reasons. Getting these certificates for him is a bit difficult task, though not impossible. I would like to know if there is any alternative for it, as he is US citizen.

I appreciate your help in clarifying this point.

If your brother is a USC, you just need to produce the naturalization certificate and a copy of the US passport. He wouldn't need to produce the birth certificate from his home country.

I read nowhere that birth certificate of the sponsor ( in this case, my brother)
is not required if he/she is a citizen.

Moreover, how are we going to establish that we are brothers if the sponsor does not produce his birth certificate.

Believe it or not it is not required, IF sponsor has any OTHER proofs of his citizenship, such as Naturalization Certificate, or/and US passport. I know that from personal experience (as well as other people's).
However, in your case I you do need it as proof of relationship to your brother. May be someone on this forum knows the easy way out, but all I can say is that your brother should try to get his “non-availability” certificate.
