Hi Everyone,

  I filed my I-130/I-485 etc with my new US citizen wife with the Chicago district office in Feb 1999. On July 17th 2001 I received a notice to deny permanent residency due to not showing up for my interview. I never got notice of this interview. I filed a motion to re-open my case, but an still waiting. I filed an I-765 to renue my EAD and they denied it due to no case being open. Now I am in Jeopardy of loosing my job, is anyone else in same situation? Does anyone have any suggestions? I don\'t want to go back to England after starting a good life for my wife and I over here.

You may pursue re-filing or the appeal, probably

Always send INS a change of address when you move while you have an application pending!

Your EAD was only good for a year, why did you fail to re-apply (I-765) in Jan2000, Jan2001 & Jan2002?

If you continue the Motion to Re-open, you will not have EAD approval until INS actually re-opens the I-485. this would probably be the day they approve the 485. If they chose to deny it, you still have nothing.

If you need employment authorization for the duration, you will probably need to file a new application.

What did INS do with the visa petition? If they denied it, you will need to file a new I-130, too.
