F2 to H1b

"hi this is kalyani,i came to Us in 2005 on F2 visa.me and my husband
got H1 approval in october 2007.i applied for the SSN.till now i didnt
get it.i can't start working without SSN.my husband is going to canada
to get H1b stamping in january 2007.i can't go without pay stub.but we
have to go to india in february 2007.if dont get the SSN before we go to
india do i need to change to H4 because my huband is going to H1b
stamping?can i go canada with him to get H4.if i change my status from F2 to
H4 is my H1 approval is going to cancel?or i can work from coming back
to india?if i get my SSN?or do i need to apply for H1 again in next cap
quota.please help me with this."
 
Hi Kalyani,

If you are a dependent on your husband, that means you will be getting a H4 visa . H4 dependents cannot legally work!! They can only go to school. You should quit working.
If your husband is going to get H1B stamping, you can go to get your H4B stamping. In order for you to legally work, have a company sponsor you for H1B(I assume here you have a professional degree), you will probably have to wait until the next year's quota is available.

But, I repeat you cannot work on H4B status. Its not legal!! This could be a problem when you apply for future immigration paperwork.
 
hi,thanq verymuch for ur reply.i know that i cant work on H4.but my H1 was approved in september 2006.still i have that.i applied for SSn 3 months back.i didnt get it.iam thinking to change to H4.do i need to apply for that i mean from H1 to H4?
 
Hi,

You have to talk to your spouse's firm's attorney/ self hired attorney to file a paperwork for bringing you back on H4.
You cannot assume that since you did not join work on H1B you are back on H4.
