My wife came here on a F-2 visa (valid till 2009). In the course of the year she wanted to work and got a compnay to do premium processing for her H1b and the visa was awarded to her. But due to some health issues she could not work specially because her employer got projects only in another part of US. It has now been more than 7 months since she got her visa. Her employer refuses to give her the visa details and the papers so that she can get it transferred to another employer near New York city.
Also, if she intends to start working from next year after going on a trip to India... would this H1b remain valid? Also some people have told us that if she goes to India she needs to get her H1b stamped at the time of returning and that there is a good chance that it would get denied. Does she stand to lose her F-2 status in that case?
Is there a way to go to India and come back and work without having to file for another H1B?
I need some help in getting these questions answered urgently and hope that there is some help available on this site.
