If anyone who has experience or knowledge on this complex thing , please share with me. I am an F1 student, after receiving my visa I married to a GC holder. Never applied for any kind of AOS since I wanted to finish my degree. Now I won DV2010. At the time of online DV application I included her as a spouse as well. Do I need to include her on DS230 or not since clearly she will not immigrate? Let's say I included..Will she go to the interview with me? There is more than a year she will get her US citizenship. a confusing situation, a wise advice is appreciated. Thanks

Case No EU10XXX

Better to have a diversity GC than a conditional one. From my knowledge, you dont need to send DS-230 for you husband/spouse.
From which country you are?

I would be happy if someone reads my post carefully if he/she wants to help. As you know, marriage to a GC holder will not entitle you to having a GC. So I am still F1 not a GC holder. And I did not choose to do AOS...But when applying to DV 2010, I included her as a spouse because that is the fact..I mean I know it seems wrong since she already has a GC, and you will ask why did you include her at the first place but you see you have to include your spouse in the DV application, right? So Please anyone who has similar/close experience or WISE advice, share your thoughts.

Yes of course I would prefer a DV green card as well..but you see it is a little bit confusing. So you are thinking that , I should not write her name on DS230?

It is not as complex as you think. There are people who have been married to citizens or have children who are citizens who still had to list their children's name on the document.I believe that you have to put your spouse name wherever it is required because that is the truth.

But I believe that there should be somewhere on the form where you indicate whether they are going to go through the process with you. Worst case, you just make sure you have a copy of their green card when you go for the interview.

You could also schedule an infopass with your local office if you still have any concerns. I assume you are doing AOS for the lottery.

This is my advice. Hope it helps.

Thanks DrMBA..No I was planning to do a CP, but I have not decided that yet. Maybe the best way is doing a AOS. I have researched this forum and other forums a lot, but I could not find someone who is in a similar situation. I guess a unique situation.. No hope from a lawyer and USCIS will most likely give a generic advice as well..It would be the best way to find someone who had a similar experience.. anyway, hope he/she shows up..
