F1 with Ph.D from China wanna apply NIW, seek for suggestions

I am a F1 now pursuing a Ph.D. after I got a Ph.D in China. I got several publications: 2 Good Intl. journals(second author),2 Intl. Conference1 First, 1 second).3 under review for top Intl. Journal(First). Besides, 5 Chinese journal (second author)(I was silly to let my advisor be the first all the time, no experience... sigh). 1.5 yrs Visiting scholar experience abroad during my ph.d study in China.
I can polish my resume and try to convince others my research are very necessary.
I wanna try applying NIW. How much chances and I am deeply grateful for any suggestions. BOW..
 
I heard that NIW is easier than before

You can try. But more important thing is what kind of job you are working on, and how to present your job is at NIW level.
At least I heard from my lawyer that NIW cases are much easier this year than 99 and 00. You may consult an experienced lawyer for evaluation.

In general, it is relatively easier if an employer sponsors you.
My impression is that it\'s very hard for students. I filed NIW petition last December and received RFE last month. I sent my reply this week and donot know what is going to happen.

My background: 10 years of Post-Bachelor experience including one year serving as deputy director of a Lab. in Tsinghua University; S.M. awarded from the top school at Cambridge, Massachusetts and Ph.D. Candidate at the same school. My supporting document included (1)a report signed by William Jeffery Clinton (the sitting president at that time) and submitted to US Congress. The report cited my work. (2) reference from deputy director of executive office of the president. He commented that I was becoming a leading expert in..., my work is a very important part of the federal govenment\'s effort to... and my contributions were having profounded.... Of course, I also had letters from professors and industry leaders, papers, patents...

Many believes that INS issued the RFE because it\'s a self petition. In addition, I believe another fact is that I have no lawyer and therefore no well-polished cover letter.

I would suggest that (1)try it; (2)if you cannot convince yourself that you satisfy the NIW standard, you need a good lawyer to wrap you up.

F-1 and Ph.D.?

It seems that you have a Ph.D. from China and is studying in US now. Am I right? Is the major you are studying is the same field of your Ph.D. degree? If so, how are you going to establish that you have made significant impact in your field and why you are getting training again in US. If not, you might have to build a correlation between your two majors. I am not very sure about what INS officer will think about, but this seems to be an obvious question at least for me. They asked for "track record of success".

I didn\'t have a lawyer but would suggest you to hire one if you donot want to suffer the PAIN.

Thanks Pain. Another question

My RFE said that three requirements of NYSDT they were satisfied with first two. But they were not persuaded that the national interest would be adversely affected if LC was required. I am a Ph.D student. How do you think to argue this point? Thanks a lot.
 
Similar situation

It\'s the similar situation.

How to argue the point totally depends on your case details. I submitted several additional hard evidences. The general practice is getting more reference letters. While it differs from case to case, my understanding is that you must address their concerns one by one. Keep in mind what makes sense is your work, not your field of work.

For EB1-EA petition, you must convince INS that you are not awared Nobel Prize only because the NP committee does not know how to appreciate you. For EB2-NIW, you get to convince them that you are saving this country. Just kidding. Good luck.
