Rajiv,

I completed my doctoral studies in Aug 2011. From then I am working with an engineering company on my OPT. Right now I am on OPT STEM extn. valid until Dec 2013. From the time I first entered USA in Aug 2006 till now, I am on F1 Visa. My F1 Visa, however, expired on Aug 2011. All the conditions for OPT, F1 Visa status are properly met by me.

I am now contemplating of visiting INDIA in next 3-4 months. When I started looking at prospectus of F1 visa renewal while on OPT STEM extn; I am getting varied opinions from different people. Some say its is very difficult and advised me to wait until I get my H1-B (which would be in Oct 2013) and some other say technically there is no reason why you shouldn't get it but at the same time ask me to keep my fingers crossed.

Could you please help me in making a decision regarding traveling to INDIA while on OPT extn..with expired F1 VISA. 1) Is it better to wait till my H1-B gets done or do I have good chances to get my F1 VISA renewed. 2) Which documents should be presented to avoid 214(b) VISA denial?

regards
Kumar
