I am doing my PhD in US with full aid since 4 years. I came to US in 2000, but was with Kaplan institute gave my GRE and GMAT and applying through schools and finally got in 2001, all this time was legally with kaplans. My F1 visa expired in 2001 and never visited back home. Recently I traveled to Canada for conference with expired visa and new SEVIS I-20 and got back with no problems. They did my fingerprinting, I did not apply for F1 then. I would like to travel to India this year, will getting the F1 visa be a problem?
My parents are back home, but my elder brother is in US with his family and have green cards, will that be an issue for me?
My wife is also in the same University as me and doing her PhD and is on F1.
Also, regarding the form, there is a question whether I have been refused for visa anytime? Initially when I applied they did not give me visa for first two times, and had my passport stamped on the last page as "application received", but I got the visa third time in same week. Now does that mean I was refused the first two times or was it just incomplete documents and should I answer yes for the above queston in the form? Because I have seen stamped passports with "Rejected" clearly stated.
