F1 Transcripts and Degree

Hello All,

I came to US on a F1 visa and had to take up a job after having some problems with my major prof. I have been working on my H1 for the past 5 years and have never been asked for my Masters transcripts or Degree. The only hole that could be in my status is that I did not register for a semester when I was waiting for my H1 to be approved. The H1 was filed when I was in school full time.

Now I have applied for my Green card (EB3) and the labor, EAD, Ap have been approved. Since it is an EB3, I have just included my Bachelors degree and the transcripts for the Bachelors degree when I filed for the GC.

Has anyone been asked for the Transcripts and Degree from their Masters during the 140 or 485 stage.
 
As long as you dont show your Masters degree for your I140 filing, your transcripts need not be shown.. Masters degree in US doesnt help you in anyway to get your GC done..
 
As long as you are working in the same or similar field of your Bachelors you don't have to worry. But if you have a Civil Engg bachelors and are working in IT then you may have to prove that your degree is equivalent to what was specified in the LC.

I have a Bachelors Degree in Computer Science and Systems Engg.

But at what stage does the INS check the status of the applicant.

They check the status even before processing your application, if there is a break in period of your non immigrant status. If you are a full time student you are considered to have taken a full course load(around 9 credits/12 credits) based on whether its quarterly/semester pattern.

If you havent maintained legal status, by staying on valid F1(is legal only if you are studying full time), applying H1, then you might encounter problems and would even subject to 3 year to a 10 year bar from entering the United States.

For example: If you have completed your studies in March 2004, then you are eligible to start working on H1B or OPT after March 2004, but as long as you havent graduated from school, you need to be in full graduate student standing to show INS that your intent was to study as a full time student.

So they do check the status before processing the Labor and EAD and AP or Do they check it before processing the 140 and 485
