F1 to J1

Hello,

I got a residency on J1 and plan to apply for a change of status from F1(OPT) to J1. My OPT is valid until 15th MAy. My studnet visa is valid until 2007. Since my residency starts on July 1st there will be a gap of 45 days between my OPT Expiration date and starting date of residency. Do I need to fill this gap with summer courses or something in order to be eligible for a change of status.

F1 (OPT) visas have a 60 day grace period. If you did not take this time during the end of your student status and beginning of OPT you should be fine. I would include an affidavit with your change of status (Form I-539) mentioning the grace period. Sometimes if it is not pointed out it is overlooked. (info@thevisaexpert.com)
