I graduated last may and got a F1 OPT approval to work from June 2009 to June 2010. In February, my employers applied for my H1b application. But this march, I got accepted into a residency program which only sponsors J1.
Yesterday, I got a notice from my employer saying that my H1 was approved ( from June 2010) without I-94 and they already have applied for a petition for correction. I spoke with the international advisor and they say that now it is not possible for them to revoke my H1 petition and also that it is not possible for me to leave the country till I get my I-94 (which takes 30-45 days). But I would need to leave the country to go to consulate to get a J1.
My questions are
1. once i leave the country and go to consulate for J1. would this create a problem as I had applied for H1.
2. Is it possible to revoke my H1 petition alltogether so that I am under F1 OPT only.
