F1 to H1 (Completed all credits but not graduated)

Dear sir,

I am doing my MS with Thesis Option. I have already completeed 33 credits for my masters ( 3 more than the required 30) and the transcripts shows that up clearly. But as I have not completed my Thesis, i have not yet graduated. I ll graduate in May 08.

Since I have completed more than 30 credits and that shows up in my transcript also, Can I apply for H1 in Master's Quota in April 08 ( before my thesis completion) ? Could someone kindly let me know..

Last year I was in the same situation. The lawyer told me that USCIS approved applying both as BS and MS, paying both of course. I ended up getting the one for BS, but a friend in the same situation for the one for the MS, so hopefully it will work again this year...

by the way, who is this "sir" you are talking about :p
 
Hi Friends,

I am in the same situation as you. I am really tensed as I have not completed my thesis defense. While applying for H1 in Master's quota, what should the letter from the university state? Should it state that all the courses have been completed but thesis is pending? The feeling that I will end up getting rejected in both general and master's quota is really worrying me :(
