F1 to F2 status change

Hi,

I am of Indian origin. I am currently in F1 and just completed my MS in Engineering. I have got my OPT EAD.

My parents are US green card holders (I aged out!). Can my parents apply for my F2B now? Will there be any issue as I am currently in F1 and it is a non immigration intent visa. If they do F2B can it be changed to F2A when they get their citizenship? If it can be done, do I retail my F2B priority date?

Yes, they can file as soon as they become green card holders. F2B changes to F1 (family F1 not student F1) when they get citizenship. You can choose to retain your F2B priority date if it is more favorable at that time (it is at the moment but may not stay that way).

current wait time for F2B to get current is around 8 years (processing priority dates before 1 May 2016). if you do not have another valid status to use during that wait time you will have to leave the US until your visa number becomes current/you will interview at a consulate.

assume you are aware but just to highlight that if you get married before your parents become citizens, the petition will lapse as there is no category for married son/daughter of LPR.
